BRT goes ahead despite appeal

In another twist to the £20million Bus Rapid Transit service linking Gosport and Fareham, a protestor has been granted the right to appeal to the Supreme Court. Previously campaigner Vivienne Morge had brought work on the scheme to a halt when she took her case to the Court of Appeal – but her case was dismissed and work restarted in June.

However while having been granted leave to appeal, this time she has failed to secure an injunction to stop work on preparing an old railway trackbed for conversion to a busway. Morge’s objections are based on damage to the habitats of wildlife.

Mel Kendal, Hampshire county council’s executive member for environment, says: “We welcome the Court’s decision not to grant an injunction and are very pleased that we can now effectively go ahead with building the BRT scheme.” He says that the area which is subject to appeal is to clarify a point of law for the future rather than to do with any inherent problem with the BRT planning consent.
